The following is a timeline of the litigation and actual copies of emails and correspondence between Bucks County Water & Sewer Authority (BCW&SA) and the Borough of Doylestown, in addition to the law suit with The Knight House, and the media coverage.

During the sale of the Borough of Doylestown’s water treatment and service to Bucks County Water & Sewer Authority, an agreement between the two parties was made that while BCW&SA would handle all operations of providing water and wastewater treatment, the Borough in turn would conduct all billing and receiving functions. In brief, to comply with the Pennsylvania Department of Environmental Protection's ( DEP) Act 537, individuals must submit planning permits to municipalities (Borough of Doylestown), who then must have it approved by sewage providers (like BCW&SA). In the case of residents and business owners in the Borough, approval was given to the individuals without the Authority’s permission, resulting in the Harvey Avenue Treatment Plant to reach capacity.

December 21, 1994

• The Borough of Doylestown sells their sewer system to Bucks County Water & Sewer Authority (BCW&SA)
  • Through the acquisition contract, the Borough becomes responsible for all billing and collection services

February 2001

• BCW&SA requests capacity need from municipalities for Harvey Expansion Act 537 Revision (Harvey Act 537)

July 2003

• Carroll Engineering Corporation (CEC) prepares ACT 537 Plan Update

July 25, 2003

• Harvey Act 537/Cooks Run Revision is submitted to Department of Environmental Protection

August 17, 2005

• Jeffrey Garton, Esquire sends correspondence to John Davis stating the Authority’s discontent for the Borough’s rescheduling 3 meetings, and requesting Change of Occupancy certificates

August 19, 2005

• John Davis replies to Garton stating that the Borough would comply with requiring planning modules for the Borough of Doylestown

December 1, 2005

• Letter is sent to John Davis from Barry Cantor noting communication efforts and requesting a meeting time

• Department of Environmental Protection ( DEP) approves the ACT 537 Plan Update that was prepared by Carroll Engineering Corporation
  • Notice of approval is sent to:
    • Stephanie Mason, Township Manager of Doylestown Township
    • John Davis, Borough Manager of Doylestown Township

April 19, 2006

• Chalfont-New Britain Township Joint Sewage Authority files an Appeal from the DEP’s approval of the Act 537 Plan for Harvey Avenue Wastewater Treatment Plant (March 23, 2006), thus delaying the Harvey Avenue STP. EHB Docket No 2006-121-K21

April 21, 2006

• Plumstead Township files an Appeal from the action of the Pennsylvania Department of Environmental Protection after approving the Act 537 Plan for Harvey Avenue Wastewater Treatment Plant

April 25, 2006

• Barry Cantor emails Benjamin Jones, and Glenn Argue, regarding communication with John Davis and Phil Ehlinger, Jr.
